Privacy Policy

(Last Updated: October 15, 2020) This Privacy Policy describes how your personal information is collected, used, and shared when you visit, become a registered user or make a purchase from thehumanecompany.com (the “Site”).  This Privacy Policy covers The Humane Company’s processing activities as a data controller. 

 

PERSONAL INFORMATION WE COLLECT

When you visit the Site, our servers (which may be hosted by a third party service provider) automatically collect certain information about your device, including information about your web browser or operating system, IP address, time zone,  date/time stamp for your visit and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites, keywords or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information”.

We collect Device Information using the following technologies:

- “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier.  We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide a more personal and interactive experience on the Site. - “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, operating system, date/time stamps, geolocation and clickstream data.

“Web beacons”, “tags”, and “pixels” are electronic files used to record information about how you browse the Site.

In addition, you will provide us with certain personal information when you create an account with the Site or become a registered user of the Site, make a purchase  or attempt to make a purchase or submit an Order for any products on the Site and/or communicate with us via the Site.  Such personal information, includes your name, email address, billing address, shipping address, payment information (including credit card numbers , email address, and phone number) and/or account login information including, without limitation, a username and password. We refer to this information collectively, as “Order Information”. 

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information. 

 

HOW DO WE USE YOUR PERSONAL INFORMATION?

We will use the Personal Information for the following purposes:

  • Fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, providing you with invoices and/or order confirmations and communicating regarding any issues or delay in the orders).
  • Verify your identity (for example, when you return to the Site and have already logged in) and to confirm new member registration;
  • Screen our orders for potential risk or fraud;
  • Personalize the advertising you see on the Site so it is more relevant to you (personalizing is accomplished through the use of cookies and web beacons, as set forth above);
  • Improve the design, style, interactive features and functionality of the Site;
  • Allow for greater ease in you utilizing the Website and its interactive features;
  • Facilitate the transactions occurring through the Site including;
  • Inform you about products, services or providing you with promotional offers and other marketing communications in connection with the Site and our products if you have opted-in to receive these type of communications;
  • Send you service messages about your registered account including, without limitation, if you clicked a password reset link;
  • Deal with, and responding to you about, a comment you have submitted for or on any of our message boards, blogs and other such user generated content facilities;
  • Enable you to share our content with others using social media or email;
  • Communicate (and personalize such communication) with you through the our newsletters, but only those you have consented to receive;
  • Administer competitions and informing you if you have been successful in any competitions or promotions;
  • Compile customer reviews;
  • Conduct market research;
  • Send a product to your shipping address;
  • Grant you access to a subscription service;
  • Deal with any query or complaint you submit to our customer services team. Only provide sensitive data (such as information about your health, race or religion) if you are happy to consent to us using it to manage your inquiry; and
  • To investigate or respond to service errors or interruptions that you have experience in order to help us create fixes and to make technical improvements. 

We use the Device Information that we collect to: (a) help us screen for potential risk and fraud (in particular, your IP address), (b) administer improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns); (c) gather demographic information about the our user base as a whole; (d) and better tailor the Site to the your needs.  For example, some of the information may be collected so that when you visit the Site again, it recognizes you, and the information is then used to market our other products and services appropriate to your interests. Except as noted in this Privacy Policy, we do not link your Device Information to your Order Information.

 

OUR LEGAL BASIS FOR PROCESSING PERSONAL INFORMATION

Our Legal Basis for Processing Personal Information

  • Consent: We will only use your Personal Information for advertising and marketing, personalization of content and services and analytical purpose (including, understanding who our user base is and how they browse the Site). If you have given us consent to send you marketing communications, you can unsubscribe from these at any time by clicking unsubscribe at the bottom of each email, or by logging into your account and managing your email preferences.
  • Legitimate Interest: We have a legitimate interest in processing Personal Information including, without limitation, analyzing traffic to the Site in order to maintain the service, such as monitoring successful page loads or error messages.
  • Fulfillment of an Order: When you engage in a transaction through the Website, the Company will need to process your details in order to fulfill the  order (i.e., deliver a product ordered through the Site to your home, we would need to use your name and address).

 

SHARING YOUR PERSONAL INFORMATION

Except as otherwise provided herein, we will not intentionally distribute, rent or sell your Personal Information to third parties without your permission, except as outlined herein.  We will share your Personal Information with third parties, as set forth more specifically below:

Our Affiliates:  We will share your Personal Information amongst our employees (to the extent such employees need the information to process any orders or administer any register user accounts) and parent companies, subsidiaries, affiliates and related entities and each of their successors, assigns, officers, members, employees, attorneys and agents, to the extent these individuals and/or entities need access to same.
  2. Third Party Processors:  We also share Personal Information with selected third parties who provide us with a variety of different services that support the delivery of our operation of the Site (“Third Party Processors”).  These Third Party Processors range from providers of technical infrastructure to customer service and authentication tools.  We do not own or operate these services and as such do not make any warranties with respect to these services, the companies that provide them, and the Personal Information that they may independently collect.

The types of Third Party Processors we may share elements of your Personal Information with include:

  • Payment processors we engage to securely store or handle payments information, such as credit or debit card details, required to undertake certain transactions through the Site;
  • Providers of email management and distribution tools - for example, if you sign up to receive any newsletters or other marketing messages we will manage the delivery of these to you using a third party email distribution tool;
  • Providers of security and fraud prevention services - for example, we use these providers to identify automated software agents that might disrupt the our services or to prevent misuse of our application programming interface(s) (“APIs”);
  • Providers of data aggregation and analytics software services that enable us to effectively monitor and optimize the delivery of its products and orders;
  • Providers of software platforms that assist us in communicating or providing customer support services to you - for example, we manage and respond to any messages you send to us via the Site using a third party communications management tool;
  • Providers of online cloud storage services and other essential IT support services; and
  • Other companies within our group, for the purpose of supporting the delivery of our services to you.

  1. 3. Compliance With Legal Requirements:  We may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.
  2. Protect OurInterests: We may also disclose your Personal Information to reveal information that is needed to identify, contact or bring legal action against you who may be violating the terms and conditions of the Site.  We may also disclose your Personal Information to take steps to protect and defend rights and property, including without limitation, our intellectual property or that of third parties.
  3. Proposed Transactions.  We may disclose your Personal Information in association with certain of our business dealings such as the exploration of any debt financing, acquisition or merger, sale of assets or ownership interests and in the event of a bankruptcy, assignment for benefit of creditors or receivership in which particular information could be sold or transferred to other parties as an asset. We may also share any Personal Information with potential business partners.

YOUR DATA PROTECTION RIGHTS

         California Consumer

  • Right to Deletion: You have the right to request that we at delete the Personal Information we collect from you.  However, in certain situations we are not required to delete your Personal Information, such as when the information is necessary in order to complete the transaction for which the Personal Information was collected, to provide a good or service requested by you, to comply with a legal obligation, to engage in research, to secure our websites or other online services, or to otherwise use your Personal Information internally in a lawful manner that is compatible with the context in which you provided the information.
  • Right Not to Be Subject to Discrimination: Should you exercise any of your privacy rights as a California consumer, we will not discriminate against you by offering you different pricing or products, or by providing you with a different level or quality of services, based solely upon your request.  However, in some circumstances, for example where you have requested or consented to our services that use your Personal Information to provide the service, we may not be able to provide a service if you choose to delete your Personal Information.

 

To exercise any of these rights, or to designate an agent or authorized representative to act on your behalf, you can contact us as set forth below.  When you submit such a request through one of these designated methods, we will use the information you submit and the information we have in our systems (or through the systems of our service provider if we use a service provider) to try to verify your identity and to match the personal information we have collected about you, if any, to your identity.  If we are successful in validating your identity, we will respond to your request within the time and in the manner required by California Consumer Privacy Act. If we cannot validate your identity, we will attempt to contact you to inform you of this issue. 

 

         European Union Resident or Citizen

  If you are a European resident or citizen, we would like to make you aware of your data protection rights including:

 

  • The Right to Access: You have the right to request us for copies of your Personal Information.  We may charge a reasonable fee for this service;

 

  • The Right to Rectification: You have the right to request that we correct any information that you believe is inaccurate. You have the right to request we complete information you believe is incomplete;

 

  • The Right to Erasure: You have the right to request that we erase your Personal Information, under certain conditions;

 

  • The Right to Restrict Processing: You have the right to request that we restrict the processing of your Personal Information, under certain condition;

 

  • The Right to Object to Processing: You have the right to object to our processing of your Personal Information, under certain circumstances; and,

 

  • The Right to Data Portability: You have the right to request that we transfer your Personal Information to another company, or directly to you, under certain circumstances.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

 

SECURITY

We use reasonable security measures that are designed to protect information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. We undertake reasonable efforts to operate secure data networks, which are protected by industry standard firewall and password protection systems.  Please note, however, that no data security measures can be guaranteed to be completely effective. Consequently, we cannot ensure or warrant the security of any personal information or other information. You transmit Personal Information to us at your own risk. We are not liable for the privacy of email addresses, registration and identification information, communications, confidential or trade-secret information, or any other content stored on our equipment, transmitted over networks accessed by the Site, or otherwise connected with your use of the Site.  We assert that we will notify you, within the time required by applicable law, if any data breach is determined to have occurred.

DATA RETENTION

We will retain your Personal Information, subject to the below exception for anonymous Personal Information, for as long as necessary to fulfill the purposes we collected it including for purposes of complying with any legal, accounting or reporting requirements.  In addition, when you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.  In addition, any Personal Information or automatically-collected information that we hold onto will be anonymous. Any personally identifiable Personal Information such as your name, address, date of birth and telephone number will be deleted after a defined period.  The rest of the data is therefore anonymous and will be used to analyze general market and website trends but without an identifiable Personal Information.

 

CHANGES

 To the greatest extent allowed by law, we reserve the right to revise, change, amend, alter or modify this Privacy Policy at any time and in any manner, without notice. Any such changes shall be effective immediately upon posting, unless otherwise stated. Your continued access and use of the Website constitutes acceptance of those changes.
